U.S. Olympic Committee Sues Logan Paul’s Prime Energy Drink For Trademark Infringement
The U.S. Olympic Committee has filed a lawsuit against an energy drink brand affiliated with a pair of popular YouTubers, accusing the company of trademark infringement. The lawsuit was filed in the United States District Court for the Court of Colorado. The Olympic Committee alleges YouTube stars Logan Paul and KSI’s energy drink company PRIME, have been using trademarked symbols and phrases as part of a recent promotion featuring NBA star Kevin Durant.
The lawsuit calls Prime Hydration’s marketing campaign as “willful, deliberate, and in bad faith,” in its use of trademarked phrases and symbols associated with the 2024 Olympic Games in Paris.
PRIME is alleged to have used Olympic Games trademarked phrases
According to the lawsuit, PRIME repeatedly used “Olympic-related terminology and trademarks” in its product packaging and in online advertising campaigns with Kevin Durant. The lawsuit names several phrases that were used in the marketing campaign. These include: “Olympic”, “Olympian,” “Team USA,” and “Going for Gold,” the lawsuit says. Advertising copy included in the lawsuit for various PRIME products show references to phrases such as “Kevin Durant Olympic Prime Drink,” and “Celebrate Greatness with the Kevin Durant Olympic Prime Drink!” Recently, the posts citing the infringed-upon material were taken down and no longer visible on Prime Hydration’s social media channels including Instagram and LinkedIn.
According to the lawsuit, the Olympic Committee contacted Prime Hydration on July 10, requesting that the company stop using all trademarked phrases in advertising materials. Those affiliated with the energy drink company ignored the request to stop using trademarked materials, the lawsuit alleges, and continued to promote their drinks using Olympic-trademarked phrases.
The Olympic Committee is seeking all profits associated with the energy drink sales as well as unspecified damages related to trademark infringement.
Not the first time PRIME has been in legal trouble
The energy drink brand has faced lawsuits and unwanted attention in the past. Last year, Senator Charles Schumer of New York called upon the Food and Drug Administration to investigate PRIME because of the extremely high levels of caffeine present in its products. There were also concerns that the marketing efforts were targeting young people. Prime Hydration was also sued in April 2024 in the Southern District of New York over “misleading and deceptive practices” regarding the brand’s drinks. The drinks contain between 215-225 milligrams of caffeine. The drink advertises that it has 200 mg of caffeine.
